So, apparently. what happened last night when i was briefly stopped by the cops. was detainment. that’s what detainment is which. i didn’t understand untill just now. right ok.
but. was it legal, or not?
hm.......... apparently. legal grounds for um. detainment incluved:
-a cop has the right to briefly detain someone [a suspect. but legally, i didn’t do a thing wrong. and wouldn’t they have mentioned, a crime at some point during the conversation? maybe not] um. for investigative purposes.
so ‘to investigate’ means to. a ‘carry out a study into’. so in other words. to........ carry out getting information from, kindof. or ok. to look into something further. more. so to get more information from a potential suspect. [yes but again of what. i didn’t do, anything. and he should’ve mentioned a crime, if he thought........].
i am so confused right now.
so if a cop doesn’t have. reasonable suspicion. then. that means. they’re not actually required, to tell me i’m er i mean i was. rather] free to leave. ok.
so apparently. in detainment situations. it’s up to the person who’s being detained to decide, if they’re being uh. detained. yes but at the time i didn’t understand what detainment actually was. like i’d heard of it but that was it.
for some odd reason. having learned all this just now. i feel. violated.
by the way. he didn’t ask to see my ID. but i was prepared to let him see it.
so all the above. states it was legal. so..........um.
so. [i looked this up via msn]. then. i clicked on ‘what is unlawful detainment’. and one link i clicked on says......that....... um. ‘Unlawful detention means keeping in custody unlawfully. Under criminal law it means keeping or confining a person in custody without any lawful reason.’
right yes exactly. again. what lawful reason? they should’ve told me about some crime that was going on if they thought..........
on the whole thing. 1. no he didn’t forcibly touch me. 2. no he didn’t physically restrain me. [quite frankly. i was afraid of what would’ve happened had i not, answered the questions. er his questions. i’m a small woman they’re 2 medium size guys.].
alrite again. i’m not one to accuse people........but........
-
if he had been required to mention a crime during the conversation. and did so then yes that would be um. legal detainment.
-
if not. [bc well. cops.]. if he had been. required to mention a crime and failed to do so. then. well...........um. wow.
now again i’m not sure. i’m not accusing. i just want to get the facts straight.
ok so. according to a guy i know from boarding school. a police isn’t legally required to mention a crime. w/o. probable cause. [being a warrant.]. so........ok. i think. i’m still not too sure but...........oh. oh wow.
so. wait. if they don’t have a warrant then they’re.......... if they don’t have a warrant. then. they don’t have the legal right to mention the crime. er i mean. they’re not legally required to.
ok. so.......... i. never saw a warrant he never mentioned it. wait. no. probably cause is........that. probable cause is. the protocol by which. an officer has reason to obtain a warrant.
alrite so. from my end. there was never a warrant seen or mentioned. and if he had one. then. it’s 2.......... and again. from my end. this is just, a guess that i have.
o..........k. um.............i don’t like this feeling.
