see. looking back what tipped me off. during that whole thing last night. is that they the both of them. were physically in my way blocking me. so the only ways i could’ve gone were to the right where the street was. [not bloody likely.]. or to the left where the fence and houses were. or walked back to where i live. [but after 2 hrs. of already walking. i certainly wasn’t going to walk all the way back.].

so i mean. that. that says something. they didn’t tell me ‘don’t leave’. well not in those exact words.

had i known. then what i know now about being detained. i probably would’ve asked ‘am i free to leave?’. but i simply didn’t know. had they not waited around and left. oh. i didn’t realise that.........if someone doesn’t ask that question. then the cop will think the person’s voluntarily staying.

he didn’t tell me i was being detained.

oh so apparently. i had the right to not talk to him.

he didn’t tell me. ‘you’re not leaving untill i get what i want’. no actually. he didn’t say anything of the sort. so i technically was free to go. but i was just too afraid to.

oh crap. also. not only will the cops think the person’s voluntarily staying but evidently so will the court.

oh..........so.............cops depend, on fear and intimidation. which then forces the person to give up their rights. oh.

and they’re trained. to be manipulative. oh..........that’s.......

and he didn’t say to me. ‘you’re not free to leave due to this’. he didn’t give me the reason. ok so for the future if that ever happens again. i’ll hopefully remember to ask ‘am i free to leave?’. wish i’d known that.

yes alrite. he gave me an indirect instruction. ‘hold on’ or something along those lines.

so pretty much. i got interrogated last night. since apparently: ‘

and actually. they’re not actually, required to read me my rights. yes. so........they asked me more then my name and address. [which again. i didn’t give them my address.].

Police can detain you only if they have reasonable suspicion (see below) that you are involved in a crime. Detention means that, though you aren’t arrested, you can’t leave. Detention is supposed to last a short time and they aren’t supposed to move you. During detention, the police can pat you down and go into your bag to make sure you don’t have any weapons. They aren’t supposed to go into your pockets unless they feel a weapon. ‘

where was the involvement? cause i wasn’t.

ok so.........ok. ‘reasonable suspicion’ means. that they actually need detailed evidence in order to have detained someone. oh.......um..........

i wanted, to terminate the conversation in fact. i told him something like ‘i want to be by myself’.

actually no i was wrong. an ‘interrogation’ is when a cop questions the suspect.
i wasn’t suspected of anything. that i’m aware of. yes. exactly. and that’s where the ‘unlawful/illegal’ part comes in.

so evidently when they stood. physically in front of me. that was their way of er. that probably meant that. they thought i was suspect. and. they should. have. supported that claim w/ uh evidence. which. well............right.
they stopped me for a reason. they didn’t want me to leave. oh. they don’t actually have, to tell someone they’re a suspect.

the only things i was legally required, to give. were my name, address, dob.

i remembered though.
1. to not leave. [well now that i know i might’ve been unlawfully detained..........]
2. and um 2. to be nice/polite. never argue w/ them. i didn’t argue i was polite. and i even told the guy ‘i don’t want to be impolite but.......’ 3. after a bit to keep my hands where he could see them.

i wasn’t arrested. so therefore i was um ‘entitled’ to go about my business.

so. ok here’s what i remember:

-the cop said ‘hi’ i responded w/ ‘hi’ -he asked me ‘what’s your name birth date where do you live’ and then wrote it down
-he asked me where i was going and maybe something about where i’d come from
-he told me he was going to call the lady
-on the way back to his car after i’d told him ‘i’m confused....this is new to me’ he went ‘no it’s all good. we’re friends’. [as if i didn’t trust cops before.......]
-he got ahold of his co-worker who actually came
-i met his co-worker
-they the both of them actually stood in my way blocking it.

the last one really sticks out. they were obviously stopping me from something.
