Work is a mixed bag today.
Busy, not busy, winning, not winning. Just.... a day.
Started the day with oversleeping. Because I didn’t oversleep at first. You see, last night I woke up at 3 am. I went back to bed at 4, hoping to awake at 6:30. I awoke at 7:40. A considerable difference.
I had a hearing first thing this morning. Civil Landlord/Tenant issue. I hope I kicked ass because the judge still hasn’t issued a ruling. BUT… here are the facts
(1) Tenant, we shall call LI. Li sent her rent check when her July rent was invoiced. This property is a business property and because Des Moines is one of the “top 100 trafficking locations” according to the DM Register (November 16, 2016: http://www.desmoinesregister.com/story/news/2016/11/16/des-moines-identified-top-100-human-trafficking-site/93952890/) this Massage Parlor has been continually harassed by Police for the last year. The police found ZERO evidence of trafficking; but shared their ongoing investigation with Landlord.
(2) Landlord, we shall call Doug. Doug decided that he didn’t want his locations being investigated by police and did not cash Li’s July rent check. Near the end of July, Doug sent Li a Notice of Unpaid Rent. BY LAW Li had three days from that notice to pay back rent.
(3) Li hand delivers a check for July and August for $2400 two days after the notice.
(4) She then sends another check for $101 to take care of any late fees and the like.
(5) Doug and his company refuse to deposit either of those checks but do admit to receiving them.
(6) Doug and his company issue a Notice of Eviction and demand Li and her business vacate due to “Unpaid Rent.” Yes, the rent they have been receiving but not depositing.
(7) So we have a hearing. Where they keep saying “But police… and rent” and I keep saying “the law, and the evidence BOTH parties submitted that prove the company has received the checks.”
Honestly… I think we should have won handily. But the order hasn’t been submitted yet so… who knows? But seriously. You can’t tell someone “You owe us rent!” receive that rent and say “We want to evict you, so we refuse to deposit this money!” You’re being. Shitty.
But then the rest of my day was kind of errand boy work. I mean the only cases I personally have active are (as follows):
Boone Psychoduck who makes his own life worse with every shitty decision he makes. My whole, entire, 100% goal at this point is to (1) argue for him in Boone because the State is bullying him by charging him with 5 crimes (that they can’t prove) because the 4 they can involve running from police.
Moslim Alcoholic who called his interpreter the day of hearing to say he wasn’t going to show up. Police still haven’t arrested him again.
That’s pretty much it. So… errand boy it is. Drafting a lot of things. Piling up a meager 2 hours of billable hours. Tomorrow will be… much the same in many ways.
(1) Boone Psychoduck. So wake up at ass in the morning, drive an hour to speak with a mentally unhinged prisoner.
(2) Ames Day… full of not much except for going over old cases and correcting errors made because “Jon was too tired, Yang was too tired, or I made a mistake.”
(3) Then a Back to School International Students Event that I have to be present from 3:30 to 7.
Funny thing is… I’ll have left for work at 7 a.m. Wife will leave for work at 12:50 pm. I will return from work at 8:00 p.m. Wife will return from work at 10:20 p.m. And I’ll have to hear about her long day and how her life sucks. It is part of what is plaguing her, and I realize that. She is so depressed that she can’t see any world outside of her own. But… it is quite something to be pulling days like that (10, 11, 12 hour days while getting paid for 3 to 5 hours max) and hearing Wife come home to sink further into her depression because she works an 8 hour shift that she despises.
