Last night I took John to a meeting. I had to hide just how shocked I was at his appearance. He had tremors that made his hands shake so badly that he could not drink a half cup of coffee. and spilled it all over the floor. We did get a lot of sympathetic looks and also help to dry up the floor. I arranged to meet him this am at the Court and help him through his hearing. We had been unable to get him a Lawyer a/c of the fact that in the first half of 2014 he earned too much money.
John had been issued five tickets. Heaviest of the bunch was DWI. They Reckless driving, Leaving the scene of an accident, failure to report an accident and failure to maintain control od his vehicle. This was some serious charges he was facing.
John was a mess when we met. He looked scared to death but much smarter than last night because he was drinking coffee from a cup with a lid. I took him up to Last night I took John to a meeting. to the Prosecutor.
The heaviest of the group was the DWI. Thee Prosecutor reviewed the arrest papers and noted the Blood Alcohol Level was .o5 which is beneath the NJ limit. I ha told John to allow me to deal with the Prosecutor and he started to speak until I nudged his ankle. The was notice taken the he had failed the manual testing but I told the Prosecutor that John reacts poorly to stress and he agreed looking at John there. They dropped the DWI charge with 6 month loss of driving privileges and we agreed to plead guilty to the Feckless Driving. Three month suspension , lessor fine, lower point. Next we went onto the leaving the scene of the accident and I argued that the site was in a Super Market Lot and John had just pulled to the end slot. Dismissed !!. The remaining two tickets we split. They dropped the Failure to have his vehicle under control and John pled guilty to not reporting the accident, which was less of a fine. I told the Prosecutor the the response of the police was less than five minutes but he looked at me over his glasses and said ” Quit while you are ahead.”
The outcome was so much better than we had hoped. Two things were in our favor. The Police Sargent told the Judge that he knew John as a neighborhood resident ant that the never had any problems with him. The other thing was John did not tell them he was on prescription meds for his depression and anxiety at the time of the accident. Now we can just hope that John will start to rebuild his life and sobriety.
