Bar Bar The Elephant: Day 4 in Book One: The Not So Daily Briefs 2014

Oh, spending a Saturday studying. Something I’d better get used to, eh?
Today still wasn’t the “deep dive” as I am still working through the Foundation Courses. Finished Torts (negligence and other) and started Constitutional Law (federalism).

I have to admit… I did much better on the Spot Check for Tort: Negligence than I expected I would. Granted, it wasn’t flying colors but it was 67%. Though… in negligence, a lot of times it comes down to wording and my ability to figure out what is actually being said… which can change QUITE a bit between practice exams and the actual bar!

As for “Various Torts: Strict Liability and Other Concerns”? Yeeeeaaaaah, only 36% correct. NOW I know why my diagnostic bar exam went so poorly. Though, considering what we covered when I was in school… I’m not surprised I got the questions correct that dealt with (1) liability in regards to animals; (2) strict products liability; (3) newspaper publication; or (4) appropriation! Guess I just have to really cover Abnormally Dangerous Activities, Misrepresentation, Nuisance, General Products Liability, and Defenses!

…and my Constitutional Federalism quiz? Wow… I mean, I thought I had done fairly well on the diagnostic… clearly, I have a lot of room to grow as I only got 53% of the questions right. Though, I will say I was more split about questions in this category. Either I’m right and doubting myself, or I’m wrong and guessing well, lol.
