Update: we are waiting on more info from a property in Morrison, TN its 5 acres and within our price range. Its a bit weirdly shaped but it can be divided and its partially deforested. It’s also behind a bunch of houses in a subdivision type thing but there’s enough trees blocking it, it looks like. Nobody has done a soil test on the property ever so that would have to be put into our offer. But there were deed restrictions that applied to us. Thing is, the last time they were renewed was in 1989. Deed restrictions should only be valid for 25 or 30 years depending on the county. Our realtor called the county and they were extremely unhelpful. The lady was like oh I never heard of them expiring but you “should be fine” to build on the property. Yeah, no, so now our realtor is gonna call a more legal type of counsel to get advice on that. Because if that’s gonna cause us issues getting building permits that is gonna be bad. But if those are expired we have nothing holding us back other than the soil testing. Waiting is just so god dang annoying.
Deed restrictions are so annoying. The original property owner usually has something out there and then the subsequent owners have the choice to renew them or not but its really stupid that past owners have any say on what happens to the land after they are long done with the property. But from 1989? hell no.
