Posing a Question (Hypothetical)/ And then an Entry :) in Book Seven: Reconstruction 2020

First, there are elements that must be accepted as FACT and not up for debate.

(1) Any form of Solitary Confinement has the potential to be psychologically damaging.
(2) Many violent offenders already suffer from some sort of psychological issue.
(3) Therefore, solitary confinement for violent offenders has a higher likelihood of compounding or worsening psychological issues.
(4) Child Offenders or “Delinquents” are defined as any individual under the age of 18 that has broken the law.
(5) Child Offenders differ from Adult Offenders due to psychological and physical development
(6) Many Child Offenders suffer from some sort of psychological issue.
(7) Therefore, Solitary Confinement for Children is inherently more psychologically damaging as compared to Solitary Confinement for Adults.

We are required to take those as FACT due to a Federal Ruling that this Hypothetical is partially based upon.

NOW… here’s the “problem.”

A facility that houses violent Delinquents has experienced a rash of staff assaults. The violent juveniles are beating the staff mercilessly, typically resulting in faciomaxillary injuries often resulting in zygomatic fractures.

In order to remove the violent Delinquent from the situation, in order to allow staff to heal and resume order, Delinquents were placed in a “solitary cabin.” This is a single large room with only a chair and a bed. Traditionally, the Delinquent was placed in the room for a single hour. If they continued to assault staff, they would be placed in the “solitary cabin” for additional time never exceeding 12 hours.

A lawsuit was filed and Plaintiff Counsel won. The Federal Government considers the use of the Solitary Cabin to be deemed “cruel and unusual punishment” and is to be immediately discontinued.

QUESTION: Without adding staff or increasing the budget- How do you deal with/resolve the issue of Delinquents beating the crap out of staff?
NOTE: The use of violence of any kind against the Children Offenders is strictly forbidden as is any use of “solitary” placement of any kind.

This is a hypothetical for you because it is a “fun brain exercise” that doesn’t necessarily impact you directly.
This is a massive problem for me because it is absolutely a problem I am trying to figure out. (ONE OF MANY)

Now for some less abstract things.

AND WE START TALKING ABOUT A DREAM. HA! Get it?! “Less abstract” was a segue into discussing a dream. I laughed.

But yeah. You know how my dreams tend to take really interesting narrative form? And how I would make a mint if I ever wrote them into script form and got them filmed or published? Last night’s dream wasn’t a narrative form. But it would make A LOT OF MONEY if it were real!

In my dream, I was playing LEGO Dragon Ball. Do you know those LEGO Star Wars and LEGO Harry Potter games? It was like that. For all of Dragon Ball. Dragon Ball, Dragon Ball Z, Dragon Ball GT, Dragon Ball Super and all the movies.

Do you know how disappointed I was when I woke up?!? Because that game doesn’t exist. LEGO Dragon Ball is not a real thing. I can’t play that game. WHY!?! That game should TOTALLY EXIST! Dr. Briefs and Capsule Corp are already part of the narrative! You’re telling me a game involving Dragon Ball and LEGO can’t happen? GET THE FUCK ON IT, WORLD!

Well… apparently I was way too wrapped up in that dream because I woke up SUPER late. Damn. Was VERY late getting to work. But honestly? I don’t care enough to be mad at myself. I still got all of my work done and the world didn’t fall apart because I was tardy.

First issue of the day? A REALLY weird juvenile case. Like… this Attorney is asking me to do a whole bunch of stuff that the Juvenile Court Officer (JCO) and I are just… scratching our heads trying to figure out “What the hell?” So the JCO and I have a long phone call where we basically just agree… this isn’t our jurisdiction. Yes, the juvenile is being held here. But the court order for that came from outside our jurisdiction. So I tell the attorney, “You’re uh… gonna have to take this matter up with THAT jurisdiction.” The attorney e-mails me back saying, “Yeah, but they said you were in charge of disposition.” No. No, no, no, no. I finally see the problem and… poor guy.... this is why Criminal Defense Attorneys that are trying to deal with Juvenile System need a little more training sometimes. Our facility is holding him BECAUSE OF a Court Order out of the OTHER jurisdiction. Quite literally… as SOON as the OTHER jurisdiction files a Court Order saying that we are no longer required to hold him; we’ll let him out. We’ll kick him out. We don’t want to be holding people that we don’t have to. How is that… news?? So… it was like… wow. This got convoluted and fucked up really fast when really… the whole thing was just “You’re looking for a court order from a different county.”

THEN… how’s this for irony… echoes of the past!

I’m dealing with a Defendant who is a Chinese Immigrant, who was here on a Student Visa but has since started the naturalization process because she got married to an American while she was here. I don’t need any of that information, obviously, but I am always curious because… past life of dealing with Chinese Immigration! And just like I encountered IN that past life with Chinese Immigration… this lovely plum blossom has an entitlement problem a mile fucking long.

This county does One Thing the same way every time. I have worked very hard to make sure that people who need a Driver’s License can legally GET a driver’s license and then KEEP that license. It takes a lot of doing. Because so many people drive around with suspended licenses. Because if you don’t pay your Child Support or your Court Mandated Fines; the State suspends your license. SO… my work around? YOU get your license unsuspended; I’ll take your Driving Under Suspension Charge and turn it into a “You forgot your license at home” whoopsie doodle. Now, yes, technically… that “whoopsie doodle” still has a fine attached. But it DOES NOT go against your license possession and can save you from being revoked or have your license taken away. I’m not PROUD of this accomplishment because it is something NEEDED but I am happy I was allowed to make this deal happen and get standardized.

The Chinese Woman I am speaking with has given me proof of license. So I send her the plea form to sign so I can file and we can finish the case up. She flips out. Pissed. Angry. I ask for details.

She got her license suspended because of a car accident (sorry to fall into prejudice but… I remember the Chinese Clients and Staff Members driving and YES they were all SUPREMELY SHITTY drivers with multiple accidents on their records). She got into a car accident that resulted in multiple criminal and civil fines that she chose not to pay. SO her license was suspended. But, of course, a suspended license didn’t mean that she stopped driving. Thus, she was cited for Driving Under Suspension. That’s when my system kicked in. She paid her fines and got her license which is what she sent me.

So far so good. That sounds like what you were expected to do. So… you paid your outstanding fines, you got your license, you provided me proof of license, so now I make the Suspension go away and you get the traffic ticket Whoopsie Doodle.

NO! I just paid fines. If I knew I’d have more fines to pay, I wouldn’t have paid the initial fines in the first place!!

Oh.... oh my God. Seriously? You’re actually saying that to me? Honestly? You’re… you do realize that not only is that a really stupid thing to say in general but you are telling the Prosecuting Attorney that, had you known additional fines would be incoming, you wouldn’t have paid your initial fines and would have kept driving illegally.

What a twit.

Ah, but how can we be upset with stupid criminals when our own State Governor is proving that, in her desperate appeal for Trump’s praise and Pence’s visits; she’s willing to be an absolute CUNT MONSTER!

Y’know how everyone is trying to figure out IF students should go back to school or not? Y’know how there are several possible answers and different resolutions that could be tried? Y’know how ultimately, each parent should probably be the person making decisions for their child?

GOVERNOR REYNOLDS JUST ISSUED A PROCLAMATION PROHIBITING SCHOOLS FROM ONLINE INSTRUCTION!!

The. Fuck?! I understand giving interviews where you “strongly encourage schools to open back up and students to return to school” but this is ABOVE AND BEYOND any hint of… just… fuck! Actively making it UNLAWFUL for schools to choose to be virtual. I try to reserve using my Lord’s name in vain because it is genuinely something I see as inappropriate but in reviewing this government mandate? JESUS CHRIST THAT IS STUPID AND EVIL.

This next item is small, simple, and out of character for me. FOR THE MOST PART- I do not like revealing someone’s real name in these pages. ESPECIALLY not both their first and last name. This is an exception.

I just got an e-mail from somebody’s secretary. Her name?

Honestly. That’s not a Company. That’s a person. That’s a person’s real name. I’m not sure if that’s the coolest name ever or not but… it’s a damned good name. The kind of name someone couldn’t earnestly use if they were writing Real World Fiction because it sounds TOO MUCH like a fictional character name!

Oh my patient and understanding Christ!! Boss’ political speak friend had to wait for the boss to get off the phone… so he engaged me. TRUE TEST OF DIPLOMACY, CHRISTOPHER! Well, what we discovered.... (1) He believes that there is a global cabal… one group that runs ABSOLUTELY EVERYTHING and the reason America is so fucked right now is that they are trying to punish Donald Trump because Trump has fucked up their global schemes so intensely. RE: I laughed and said that there was no evidence of that. He, of course, disagreed and said that I wasn’t looking. (2) He believes that PC (Politically Correct) is (literally his exact words) Evil and From The Devil. That PC is just lying and everyone who embraces PC is trying to hurt the world. I suggested that I LOVE being diplomatic. I thoroughly enjoy telling someone to go fuck themselves in such a way where the other person says Thank You. He disagreed. (3) He believes that the Media hasn’t been honest since September 11th. That the media is in control of everything and that since they control the flow of information; nobody knows anything that’s actually going on anymore! (4) Then he stated that the government is corrupt. I agreed and cited Donald Trump. BLEW HIM AWAY! He meant NOT Trump the OTHER government. I insisted that Trump has violated so many ethics rules he is an important figure in discussing corruption. No, no, no, he insisted… Trump just isn’t political he takes everything personally that’s all. To which I said, “And isn’t that terrible? Imagine a professional, a person in power, that takes absolutely everything personally.” HE thought and said, “Yeah. I can see how that would be bad in other positions. But I think Trump is all right.”

Then Boss got off the phone, so they continued their discussion on how the Government is too big, takes too much money, is too corrupt. THEN Discuss how schools (direct quote) “don’t use good teachers no more” and they suspect that it is because good teachers get punished and thrown out. THEN (because they know how SHITTY these comments actually are) they lowered their voices to start talking about how “too many different cultures bring chaos and disaster to anywhere.” YUP. Ladies and Gentlemen… our Steve King Dog Whistle! The ongoing march of “Fuck any non-white culture because OUR culture is best!” THEN a full diatribe of “Fuck immigrants, they need to assimilate, bringing in their own ideas and beliefs is poisoning our country!” AAAAAaaaaaaaaaaaaaaaaaaaaaaaaaaaaand now a discussion on how Islam is a devil religion poisoning our nation and how Muslims have destroyed America and Patriotism. Because Muslims and Black People have “infiltrated the military and are corrupting it from within”

OH MY GOSH… he came back around to tell me that he had thought about the Goya Ethics Violation and thinks Trump did the right thing. “After all” (apparently) “It is the only way to fight Cancel Culture. And Cancel Culture is truly evil.”

OBVIOUSLY, I don’t like the idea that people like this are in our government. I just… THIS LEVEL of idiocy, conspiracy theory, and blindness. MAN!
